Reckless Driver Plows Through Stop Signs, Beer in Hand, Kills Family

A 50-year-old man was driving his 2004 Subaru east on Forest Road West in Mastic Beach at around 10 p.m. when his car was struck by a 2006 Ford Explorer. The Ford was traveling south on Huguenot Drive. The Subaru had the right of way based on the stop sign on Huguenot at the intersection. According to Suffolk police, the Ford’s driver, a 24-year-old resident of Mastic Beach, was speeding at 68 miles per hour in a 30-mile per hour zone, with an open beer in his hand. He was blowing stop signs in the residential area when he struck the Subaru.

The Subaru’s driver and his 41-year-old wife riding in the car were pronounced dead at the scene. A 22-year-old passenger in the Ford was taken to Stony Brook University Hospital for treatment of non-critical injuries.

Driver Flees Scene, Later Arrested

The driver who caused the accident reportedly fled the scene on foot following the crash. Police investigated and ultimately arrested the driver on charges of leaving the scene of an accident resulting in death. Court records show that the driver was previously arrested in June 2017 on suspicion of driving with a suspended license and criminal trespass.

Ford Driver at Fault for Fatal Car Accident

Pursuant to New York traffic laws, motorists must come to a complete stop at a stop sign. By failing to do so, the Ford driver created the dangerous situation that ultimately led to the accident. According to the indictment filed against the driver, he was also traveling at more than twice the speed limit and had an open container of alcohol with him at the time. He also violated state law by failing to remain at the scene of the accident.

In this instance, the family of the Long Island couple are entirely within their rights to bring a wrongful death suit against the Ford driver. Based on his violation of state traffic laws, he was clearly at fault for the accident and is likely open to significant liability based on his reckless conduct and the deaths he caused.
